Cimarron Ag Beta Loaner Addendum

Version 0.1. This applies to sensors we lend you for field testing. It adds to the Terms of Service. Where the two differ, this addendum controls for loaned sensors.

B1. This is a test

The sensor is a prototype. Expect bugs, outages and gaps in the data. We may change or stop the beta at any time. THE LOANED SENSOR AND THE SERVICE ARE PROVIDED "AS IS", WITH NO WARRANTY OF ANY KIND. The warranty in section 7 of the Terms does not apply. Sections 3 and 10 of the Terms apply in full. Because the beta is free, our total liability to you is limited to $100.

B2. The sensor is on loan

The sensor stays the property of Cimarron Ag LLC while you host it. Please do not sell it, lend it out or open it, and please let us know before moving it to a different site.

B3. Giving it back

If we ask for the sensor back, or when the beta ends, please hand it back within 7 days or let us onto the property to collect it. We will usually come and get it ourselves.

B4. If it gets lost or damaged

Ditches are rough places. Floods, ice, cattle and theft are our risk, not yours. Just tell us what happened. The exception: if you keep the sensor after we ask for it back, and do not let us collect it within 30 days, we may bill you the replacement cost of the sensor.

B5. Site visits

We may need to inspect, service, change, swap or remove the sensor. We will give you at least 48 hours' notice by text, email or phone, and come at a reasonable hour. You are welcome to come along. We come at our own risk, and we will fix any damage we cause. If something urgent comes up, we may call and ask to come sooner.

You confirm that you can give us this access. If someone else owns or controls the ground, tell us and we will ask them too.

B6. Your data during the beta

Your data is still yours, and section 8 of the Terms still applies. The point of a beta is to improve the product, so we will look closely at the raw readings and diagnostics from your sensor. We will not publish anything that identifies you or your site without asking you first. That includes photos of the installation.

B7. Feedback

We want your honest opinion, good and bad. We may use your ideas and suggestions in the product without owing you anything for them.

B8. Pre-release hardware

Show it to your neighbors all you like. Please do not hand it to anyone to take apart or copy.

B9. Free now, paid later

The beta is free, and we are grateful for your help. If we later start charging for the service, we will let you know at least 30 days ahead, along with the pricing and any options for keeping the sensor. You can then decide whether to continue. If you would rather not, just hand the sensor back and you owe nothing.

B10. Ending the beta

Either of us can end this at any time, for any reason, by telling the other. B3 then applies to the hardware. You have 90 days to download your data.
