Cimarron Ag Terms of Service
Version 0.1. Effective September 22, 2026.
The short version
- The sensor tells you what your water is doing. It does not control your water. You stay responsible for your ditch.
- Your data is yours. We do not sell it. We do not hand it to anyone unless you tell us to or the law forces us to.
- Prices are shown when you order. Service is a monthly subscription per sensor. You can cancel online at any time.
- If the hardware fails in the first year, we replace it.
- Alerts can be late or missed. Do not make the sensor your only check where a failure could cost you.
- If something goes wrong, the most we owe you is what you paid us in the past 12 months.
The full terms are below. The short version is a summary. If the two differ, the full terms control.
1. Who this agreement is between
This agreement is between Cimarron Ag LLC, a Colorado limited liability company ("Cimarron Ag", "we"), and you. "You" means the person or organization named on the account. If you accept for a ranch, ditch company or other organization, you confirm you have authority to do that. The service is for farm, ranch and ditch operations.
2. What you get
You get a water-level sensor, an online dashboard, and text and email alerts. The sensor only works with the Cimarron Ag service. It will not send data anywhere else.
3. What the sensor is, and what it is not
The sensor measures water level. The dashboard estimates flow from that level and from the flume details you enter. The flow numbers are only as good as the flume, the installation and the details you give us.
The sensor is an information tool. It does not open, close or control anything. It is not a certified measuring device. Do not use it for official water reporting unless we tell you in writing that it is accepted for that use.
Alerts depend on cellular and satellite networks, phone carriers, weather and battery. They can arrive late or not at all. Do not rely on the sensor as your only protection against flooding, crop loss, harm to livestock or property damage.
Battery life and accuracy figures we publish are typical values under stated conditions. They are not guarantees for your site.
4. Installing the sensor
You install the sensor yourself, at your own risk. Be careful around moving water. You confirm that you own the place where you install it, or that you have permission from whoever does. That includes the landowner and the ditch company, where they apply. Do not block flow, cover a staff gauge, or drill into a measuring structure you do not own.
Please do not open the sealed case. Opening it ends the warranty.
5. What you own and what we own
Once you pay for the sensor, the hardware is yours. The software inside it and the online service are licensed to you, not sold. You may not copy, extract or reverse engineer the software. You may not use the sensor's cellular or satellite connection for anything else.
6. Price and billing
Hardware and service prices are shown at checkout and on our website when you order. Service is billed per sensor, each month in advance, to the card on your account. Service renews every month until you cancel.
You can cancel at any time in the dashboard or by emailing support@cimarron.ag. Service runs to the end of the month you paid for. We do not refund part-months.
If we change the price, we will email you at least 30 days before. You can cancel before the new price starts.
If a payment fails, we will tell you and try again. If it is still unpaid after 15 days, we may pause your dashboard and alerts until it is paid.
Prices do not include sales tax, which we add where the law requires.
7. Returns and warranty
You may return the sensor within 30 days of delivery for a refund of the hardware price.
For one year from delivery, we will repair or replace a sensor that fails because of a defect in materials or workmanship. We choose whether to repair or replace. This does not cover damage from impact, livestock, ice, debris, theft, misuse, or opening the case.
THAT IS THE ONLY WARRANTY WE GIVE. OTHERWISE THE SENSOR AND THE SERVICE ARE PROVIDED "AS IS". WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8. Your data
You own the data from your sensors. We use it to run the service for you, to give you support, and to find and fix problems with the product. We may also use combined statistics that cannot identify you, your ditch or your location.
We will never sell your data. We share it only:
- with people you invite to your account;
- with the companies that host and run our service, who are bound to keep it confidential;
- when a court order, subpoena or other valid legal demand requires it. We will give only what the law requires. We will tell you first unless the law forbids it.
You can download your data at any time. After you cancel, you have 90 days to download it. After that we delete it on your request, and in any case within 12 months.
If Cimarron Ag is ever sold or merged, these promises stay attached to your data. The Data and Privacy Policy has the details.
9. Text and email alerts
By entering a phone number for alerts, you agree to receive automated text messages from us at that number. Message and data rates may apply. Reply STOP at any time to end texts. Ending texts also ends text alerts.
10. Limits on what we owe you
Our prices are low because our liability is limited. Please read this part.
WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL LOSSES. THAT INCLUDES LOST WATER, CROP OR HAY LOSS, HARM TO LIVESTOCK, FLOODING, PROPERTY DAMAGE, LOST PROFITS, FINES, AND THE OUTCOME OF ANY WATER DISPUTE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
Nothing here limits liability that the law does not allow us to limit.
11. If your actions cause a claim against us
If someone brings a claim against us because you installed a sensor where you had no right to, or because you misused it, you will cover our reasonable costs of that claim.
12. Ending this agreement
You can end it at any time by cancelling. We can end it with 30 days' notice. We can suspend service right away for non-payment, misuse or a safety problem.
If we ever shut down the service, we will give you at least 90 days' notice, refund any prepaid months, and give you time to download your data.
13. Changes to these terms
We will email you at least 30 days before any important change. If you do not agree, you can cancel. For important changes we will ask you to accept the new terms the next time you sign in.
14. Disputes
Call us first. Most problems can be fixed with a phone call. Colorado law governs this agreement. Any lawsuit must be filed in the state courts of Ouray County, Colorado. Either of us may use small claims court.
15. The fine print
These terms, the Data and Privacy Policy, and any addendum or order form we both accept are the whole agreement. If a court strikes one part, the rest stays. We may transfer this agreement to a company that takes over the business and keeps the data promises in section 8. We send notices by email to the address on your account.
